Family mediation (also known as Family Dispute Resolution) is a structured and confidential process where an independent mediator assists separating couples to resolve disputes relating to parenting arrangements, property settlement and financial matters. The mediator facilitates discussion between the parties and helps them explore practical solutions that may allow them to reach agreement without the need for court proceedings.
In many parenting matters under the Family Law Act, parties are required to attempt Family Dispute Resolution before commencing proceedings in the Federal Circuit and Family Court of Australia. If mediation is unsuccessful or inappropriate, a mediator may issue a Section 60I certificate, which confirms that Family Dispute Resolution has been attempted or considered.
Family mediation can often provide a faster, more cost-effective and less adversarial alternative to litigation, allowing separating couples to retain greater control over the outcome of their dispute. Mediation can be conducted in person on the Gold Coast or online for parties located anywhere in Australia, providing flexibility and accessibility for families in different locations.
