Online Family Mediation Australia

Clarity Mediation Centre provides online family mediation services across Australia, allowing separating couples to participate in mediation regardless of their location.

Online family mediation (also known as online Family Dispute Resolution) allows parties to resolve disputes relating to parenting arrangements, property settlement and financial matters through secure video conferencing. The process is conducted in the same structured and confidential way as in-person mediation.

Online mediation offers a convenient and flexible option for families who may live in different cities, interstate or who prefer not to attend mediation together in person.

Benefits of Online Family Mediation

Online mediation provides several advantages for separating couples.

These may include:

  • the ability to participate from different locations

  • flexible scheduling for busy families

  • reduced travel time and cost

  • a confidential and structured dispute resolution process

  • the opportunity to resolve disputes without court proceedings

Many families find that online mediation allows them to address disputes more efficiently while maintaining a constructive environment for discussion.

What Is Online Family Mediation?

Online family mediation is a process where an independent mediator assists separating couples to discuss and resolve disputes through a structured mediation session conducted via secure video conferencing.

During mediation, the mediator facilitates discussion between the parties and assists them to explore possible options for resolving their dispute. The mediator does not make decisions but supports the parties to reach agreements that may work for their individual circumstances.

Online family mediation may address matters such as:

  • parenting arrangements and parenting plans

  • communication and decision-making regarding children

  • property settlement and division of assets

  • financial matters following separation

The aim of mediation is to help parties reach agreement without the need for court proceedings.

When Is Family Dispute Resolution Required?

In many parenting matters, the Family Law Act requires parties to attempt Family Dispute Resolution before commencing proceedings in the Federal Circuit and Family Court of Australia.

Family Dispute Resolution provides separating couples with an opportunity to resolve disputes relating to parenting arrangements before seeking orders from the court.

Following the mediation process, an accredited Family Dispute Resolution Practitioner may issue a Section 60I certificate where appropriate.

Who Can Use Online Family Mediation?

Online mediation is suitable for many separating couples, including where:

  • parties live in different cities or states

  • travel to a mediation location is difficult

  • parties have work or parenting commitments

  • parties prefer not to attend mediation together in person

Online mediation allows parties to participate from anywhere in Australia using secure video conferencing.

Parenting Mediation Online

Online mediation can assist parents to reach agreement regarding parenting arrangements and parenting plans.

Common parenting issues discussed during mediation include:

  • where children will live

  • time spent with each parent

  • communication between parents

  • schooling and medical decisions

  • holiday arrangements

The mediation process aims to support parents in developing practical arrangements that promote the wellbeing of their children.

Property Settlement Mediation Online

Online family mediation can also assist parties to resolve property settlement and financial disputes following separation.

This may include discussions regarding:

  • division of assets and property

  • liabilities and debts

  • superannuation interests

  • financial resources

Resolving financial disputes through mediation can often be significantly faster and more cost-effective than court proceedings.

Section 60I Certificates and Online Mediation

A Section 60I certificate is often required before a party can commence parenting proceedings in court.

Following Family Dispute Resolution, the mediator may issue a Section 60I certificate confirming that:

  • mediation has been attempted

  • one party refused to participate in mediation

  • mediation was considered inappropriate in the circumstances

Online mediation is recognised under the Family Law Act, and Section 60I certificates may be issued following online Family Dispute Resolution where appropriate.

Frequently Asked Questions
Mediation is an alternative dispute resolution process aimed to empower people to resolve their disputes without court intervention. It is becoming more and more common for people to engage in the mediation process to resolve their issues and we find that most matters will settle at mediation, even when you think that they won't! The process is guided by the mediator where both parties outline what they would like to achieve at the mediation and then are given the space to discuss this with the other party. This can be done in the same room (or virtual room if via web conference) or separate rooms, with the mediation acting as the go-between. Mediation is a completely confidential process so you can be comfortable in discussing whatever issues without the concern that it may be brought up again outside of the mediation space.

Our mediation rooms are at Mudgeeraba, near Robina Town Shopping Centre. We are located in a beautiful Queenslander building with large spaces and natural light.  While we are a Family Law mediation practice on the Gold Coast, we are able to assist you Australia wide with mediations either via telephone or via an online platform like Zoom.. With your busy life, we understand that attending in person is sometimes unachievable or may not be appropriate in your personal circumstances. We can conduct mediations via telephone or online through a video platform with a morning session running from 9am to 1pm and afternoon session running from 1pm to 5pm. With our flexible mediations we ensure that we can help all separated families in any circumstances.

We strongly believe that your family's future should not be decided on by a Judge in a courtroom. We aim to empower you to reach your own decisions for your property and parenting settlement. Often, it is possible to resolve all your issues, child custody and financial, in just one day. It is our goal to provide you with the most cost-effective and stress-free process in finalising your separation and moving forward with your life. This might be one of the most difficult times in your life, but we are here to make it a little easier on you and your family.

We offer fixed fees for our mediations which include preparation for and attendance at your mediation. The only additional charge to this fixed fee is venue hire. If you wish to reduce the cost of your mediation, you can contact us to discuss arranging your own venue hire or talk about flexible venue options, such as online mediations. Generally, fees are shared between parties so you can resolve your dispute for well under $1000.
