Clarity Mediation Centre offers in person mediation and online family mediation services across Australia, allowing parties to participate from different locations using secure video conferencing. Online mediation follows the same Family Dispute Resolution process as in-person mediation.

Online mediation is often suitable where:

  • parties live in different cities or states

  • travel to a mediation location is difficult

  • parties prefer not to attend mediation together in person

Many disputes can be resolved through mediation without the need for lengthy court proceedings.

Section 60I Certificates

In many parenting matters under the Family Law Act, parties are required to attempt Family Dispute Resolution before commencing proceedings in the Federal Circuit and Family Court of Australia.  Following the mediation process, an accredited Family Dispute Resolution Practitioner may issue a Section 60I certificate where appropriate. This certificate confirms that mediation has been attempted, considered, or deemed inappropriate before court proceedings are commenced.

Section 60I certificates may be issued where:

  • mediation has been attempted but no agreement is reached

  • one party refuses to attend mediation

  • mediation is considered inappropriate

The cost of the Section 60I certificate is included in the mediation or invitation fee.

How do your fees work?

We provide fixed fees for our mediations which are all inclusive of the preparation and the mediator's attendance on the day. As part of our flexible service, we provide after-hours mediations for the same price as those conducted during office hours. If your matter is considered inappropriate for mediation, you will just pay the fee to have your certificate issued. We charge one fixed fee for a half day mediation and one fee for a full day mediation. Our additional fee is for venue hire. If you wish to keep your costs down, we can arrange a telephone or video mediation, or you can arrange your own venue.

Who has to pay the mediation fee?

When parties consent to participating in mediation, the mediation fee is generally shared between the two parties. Sometimes you can obtain an order from the court to access funds from the property pool to pay mediation or you can reach an agreement with the other party to pay the fee this way. A court is also able to make a determination as to who should pay the mediation fee.
