What is Family Mediation?

Family mediation is a structured process in which a neutral mediator assists separating couples to discuss and negotiate issues arising from their separation. The mediator facilitates discussion, helps clarify issues and supports the parties to explore options for reaching agreement.

Family mediation commonly addresses matters such as:

  • parenting arrangements and parenting plans

  • communication and decision-making regarding children

  • property settlement and division of assets

  • financial matters following separation

The aim of mediation is to assist parties to reach practical agreements that allow them to move forward without the need for court proceedings.

Family Dispute Resolution and the Family Law Act

Under the Family Law Act, parties are generally required to attempt Family Dispute Resolution before commencing parenting proceedings in the Federal Circuit and Family Court of Australia.

Family Dispute Resolution provides an opportunity for parties to resolve parenting disputes through mediation before resorting to litigation. Where appropriate, an accredited Family Dispute Resolution Practitioner may issue a Section 60I certificate confirming that mediation has been attempted or considered.

Section 60I Certificates

A Section 60I certificate is often required before parenting proceedings can be commenced in court.

Following the Family Dispute Resolution process, the mediator may issue a Section 60I certificate where appropriate. This certificate confirms that:

  • mediation has been attempted

  • one party did not attend mediation

  • mediation was considered inappropriate in the circumstances

Section 60I certificates are commonly required before filing an application in the Federal Circuit and Family Court of Australia for parenting orders.

Parenting Mediation

Parenting mediation assists separating parents to reach agreement regarding the care and arrangements for their children.

This may include discussions about:

  • where children will live

  • time spent with each parent

  • communication arrangements

  • school and medical decision-making

  • holiday arrangements

The mediation process focuses on helping parents develop practical and child-focused arrangements that support the wellbeing of their children.

  • travel to a mediation location is difficult

  • parties prefer not to attend mediation together in person

Online mediation follows the same Family Dispute Resolution process as in-person mediation.

Mediation is an alternative dispute resolution process aimed to empower people to resolve their disputes without court intervention. It is becoming more and more common for people to engage in the mediation process to resolve their issues and we find that most matters will settle at mediation, even when you think that they won't! The process is guided by the mediator where both parties outline what they would like to achieve at the mediation and then are given the space to discuss this with the other party. This can be done in the same room (or virtual room if via web conference) or separate rooms, with the mediation acting as the go-between. Mediation is a completely confidential process so you can be comfortable in discussing whatever issues without the concern that it may be brought up again outside of the mediation space.

Our mediation rooms are at Mudgeeraba, near Robina Town Shopping Centre. We are located in a beautiful Queenslander building with large spaces and natural light.  While we are a Family Law mediation practice on the Gold Coast, we are able to assist you Australia wide with mediations either via telephone or via an online platform like Zoom.. With your busy life, we understand that attending in person is sometimes unachievable or may not be appropriate in your personal circumstances. We can conduct mediations via telephone or online through a video platform with a morning session running from 9am to 1pm and afternoon session running from 1pm to 5pm. With our flexible mediations we ensure that we can help all separated families in any circumstances.

We strongly believe that your family's future should not be decided on by a Judge in a courtroom. We aim to empower you to reach your own decisions for your property and parenting settlement. Often, it is possible to resolve all your issues, child custody and financial, in just one day. It is our goal to provide you with the most cost-effective and stress-free process in finalising your separation and moving forward with your life. This might be one of the most difficult times in your life, but we are here to make it a little easier on you and your family.

We offer fixed fees for our mediations which include preparation for and attendance at your mediation. The only additional charge to this fixed fee is venue hire. If you wish to reduce the cost of your mediation, you can contact us to discuss arranging your own venue hire or talk about flexible venue options, such as online mediations. Generally, fees are shared between parties so you can resolve your dispute for well under $1000.
